TERMS & CONDITIONS AND PRIVACY POLICIES

The terms "We" / "Us" / "Our"/”Company” individually and collectively refer to “Ezyserve” Operated and Managed by Foundry Consultancy Limited (CIN: U80302BR2000PLC009439) (Regd. office at 103, Ramalaya Apartment, Vijay Nagar, Lane No-4A, Rukanpura, Patna – 800014 Bihar, India) and the terms “You”, "Website Visitor”, ”Website or App User”, “Customer” here refers to the “User”.

This page states the Terms and Conditions under which you (Visitor) may visit this website (“www.ezyserve.com”). Please read this page carefully. If you do not accept the Terms and Conditions stated here, we would request you to exit this site.

Ezyserve or www. Ezyserve.in or Mobile App is purely act as a platform and aggregator to facilitate Service booking to arrange Service providers at customers (here users) site and get their work done on scheduled date and time.

When You use any of the Services provided by us through our Service Partner (Service Provider), including but not limited to, Electrical, Plumbing, Computer Repair, Laundry, Carpentry etc, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of these Terms of Use. As long as you comply with these Terms of Use, We grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use our platforms. In the event of a conflict or inconsistency between any provision of the terms and conditions mentioned herein with those of the particular service, the provisions of the terms and conditions applicable to such specific Services shall prevail.

We may modify these Terms from time to time, and such modification shall be effective upon its posting on our platforms. You agree to be bound by any modification to this Agreement when you use our Website and App after any such modification is posted; it is therefore important that you review the Terms of Use regularly.

Presently Ezyserve’s service is available in Bihar only in few specific cities as mentioned on our website or app.

A) SERVICE RELATED IMPORTANT TERMS:-

  1. Foundry Consultancy Limited (“Ezyserve”) shall purely act as a Service supervisor and arrange to provide services through registered service providers (/Service Partner) - the architect, contractors, engineers, technicians, agents, etc. A Service Provider nominated by Ezyserve shall be exclusively responsible for provision of Interiors/Construction/Renovation/Repair/Fixing/Other (“ICRRFO”) services.
  2. For Project or Services which is subject to approval from the relevant governmental authorities. You are responsible to obtain all necessary government permits, licenses and approvals. Ezyserve may assist you in obtaining these approvals on separate request.
  3. Once you have selected the ICRRFO package, you acknowledge and agree that your information and details may be shared with the relevant service provider(s) for provision of services.
  4. Goods and Service tax (as per Government Regulations), and any other taxes as applicable, will apply on the quoted prices for the services.
  5. Any payment that has once been remitted to Ezyserve is non-refundable.
  6. Ezyserve reserves the right to modify the payment terms, Service Fee and Service completion timelines.
  7. Other than as expressly agreed to and to the fullest extent permissible under applicable law, Ezyserve disclaims all liabilities, warranties, express or implied.
  8. Ezyserve shall not be liable for any incidental, special or consequential damages that result from the services. Ezyserve specifically disclaims any liability with respect to any notices or claims received from governmental/regulatory authorities with respect to the Construction/Renovation at the Site Property. Notwithstanding the above, the total liability of Ezyserve, if any, for any reason whatsoever, shall not exceed the commission received by it.
  9. You shall ensure a safe and secure environment for Ezyserve and Service Partner, their agents and representatives and other service providers, to provide the ICRRFO services and provide adequate space for storage of materials.
  10. You explicitly agree that you shall not solicit any ICRRFO services from any service provider directly.
  11. Ezyserve will not be liable for any ICRRFO service carried out without our knowledge by mutual agreement between you and the Service Provider.
  12. Ezyserve reserves the right to make changes to any part of these terms and conditions at any point in the future.

B) GENERAL REGISTRATION REQUIREMENTS

1) In consideration of your use of our platforms, you represent that you are of legal age (18 years and above) to form a binding contract and are not a person barred from receiving services under any law in force in India or other applicable jurisdiction. You also agree to:

    a) provide true, accurate, current and complete information about yourself while registering on our Website and  App to avail the Services.

    b) maintain and promptly update your Registration Data to keep it true, accurate, current and complete.

2) If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, We reserve the right to suspend or terminate your account and refuse any and all current or future use of our Website and App (or any portion thereof) at any time. Ezyserve will not be liable for any act or omission arising from the inaccurate information provided by You to Us while registering as user or booking any service.

3) You may access our Website and App for your service booking, information and personal use.

4) You will be required to enter a valid phone number while registering on our Website and  App as a User. By registering your phone number with us, you consent to be contacted by us via phone calls and/or SMS or whatsApp notifications.

C) SUBSCRIBER ACCOUNT, PASSWORD AND SECURITY

1) If you register on Ezyserve, you will be required to choose a password and user name. In case of Service Providers Registration, System automatically generate Password and send via SMS/email/Whatsapp. We recommend to change your default password by log in.

2) You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. You agree to:

  1. immediately notify Ezyserve any unauthorized use of your password or account or any other breach of security, and
  2. ensure that you log out from your account at the end of each session;
  3. never use any other user’s account without prior authorization from ezyserve

3) Ezyserve will not be liable for any loss or damage arising from your failure to comply with this Agreement.

D) USER INFORMATION

1) Ezyserve’s unique business model provides You with location based service providers in a short span of time. To facilitate this, You hereby authorise Ezyserve to use the location based information provided by any of the telecommunication companies/Goole when You use the mobile phone/website to make a booking. The location based information will be used only to facilitate and improve services for You.

2) If You use the Website or the App, You agree that information about Your use of the Ezyserve Website and App through Your mobile telecommunication or computer device may be communicated to us, and we may obtain information about Your mobile carrier, Your mobile device, Internet Service provider or Your physical location. By accessing the our App or Website using a mobile telecommunication device or computer, You represent that to the extent You import any of Your Ezyserve data to Your mobile telecommunication device/Computer that You have authority to share the transferred data with Your mobile carrier or other access provider. In the event You change or deactivate Your mobile account, You must promptly update Your Ezyserve account information to ensure that Your messages are not sent to the person that acquires Your old number and failure to do so is Your responsibility. You acknowledge that You are responsible for all charges and necessary permissions related to accessing our App or website through Your mobile access provider or any other medium. Therefore, You should check with Your provider to find out if our Website and App are available and the terms for these services for Your specific mobile devices.

3) Ezyserve reserves the right to collect user data including name, contact information and other details to facilitate the Services or use of its website or App to avail Services.

4) Compilation of user accounts and user accounts bearing contact number and e-mail addresses are owned by Ezyserve.

5) In the case where the system is unable to establish unique identity of the user against a valid mobile number or e-mail address, the account shall be indefinitely suspended.

6) Ezyserve reserves the full discretion to suspend a user's account in the above event and does not have the liability to share any account information whatsoever.

7) We may record your telephone calls to our call centres or to Us.

E) TERMINATION OR SUSPENSION

1) You agree that Ezyserve may at any time terminate your access to the App or Website or restrict or suspend your access to all or any part of the Website or the App at any time, for any or no reason, with or without prior notice, and without liability.

2) Ezyserve shall be entitled at any time without giving any reason to terminate the booking of services done by You.

F) PRESERVATION / DISCLOSURE

You acknowledge, consent and agree that Ezyserve may access, preserve and disclose your account information and content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to:

  1. comply with legal process nationally or internationally;
  2. enforce these Terms of Use;
  3. respond to claims that any Content violates the rights of third parties;
  4. respond to your requests for customer service;
  5. protect the rights, property or personal safety of Ezyserve, its users and the public; or
  6. pursuant to the terms of the Privacy Policy.

G) SECURITY COMPONENTS

You understand that our Website and App and software embodied within the Website and App may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by Ezyserve and/or content providers who provide content to Ezyserve. You may not attempt to override, disable, circumvent or otherwise interfere with any such security components and usage rules embedded in our platforms.

H) EZYSERVE AND THIRD PARTIES

You may be able to access links to third party sites from the App or Website. Third parties could be advertisers, affiliate partners, strategic partners, or others. Ezyserve expressly disclaims all responsibilities for such third party links. We do not warrant the products or offerings of, any of these businesses or individuals, or the accuracy of the content of their websites. Ezyserve does not assume any responsibility or liability for the actions, product, and content of any such Third Party websites. Before you use any Third Party websites, you should review the applicable terms of use and policies for such Websites. If you decide to access any such linked Website, you do so at your own risk.

I) COMPLIANCE WITH APPLICABLE LAW

You agree that You shall not use the Ezyserve Website and App in order to host, display, upload, modify, publish, transmit, update, distribute, share, store or destroy material, including without limitation Ezyserve Content:

  1. in violation of any applicable law or regulation,
  2. in a manner that will infringe the copyright, trademark, trade secret or other intellectual property or proprietary rights of others or violate the privacy, publicity or other personal rights of others,
  3. that belongs to another person and to which the user does not have any right to,
  4. that is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, threatening, abusive or hateful or racially, ethnically objectionable, disparaging, relating encouraging money laundering or gambling or otherwise unlawful in any manner whatsoever,
  5. harm minors in any way,
  6. deceives or misleads the addressee about the origin of such message or communicates any information which is grossly offensive or menacing in nature,
  7. impersonate another person or entity,
  8. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of Ezyserve’s computer systems or site or Ezyserve’s users, customer’s computer systems or site,
  9. threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states or of public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or insulting any other nation.

J) INTELLECTUAL PROPERTY RIGHTS

The Ezyserve Website and App  and contents owned by Foundry Consultancy Limited (Ezyserve). Users have no right to copy or use our Logo, contents, theme, data, images, etc. and use for his personal use or commercial use. Appropriate legal will be taken against violator.

K) DISCLAIMER OF WARRANTIES AND LIABILITY

1) All the material and products on our Website and App, (including but not limited to software) and services, included on or otherwise made available to you through our Website and App are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, Ezyserve does not warrant that:

  1. This Website will be constantly available, or available at all; or
  2. The information on this Website is complete, true, accurate or non-misleading;
  3. That the Services will meet the customer’s requirements.
  4. Ezyserve will not be liable to you in any way or in relation to the Contents of, or use of, or otherwise in connection with its Website and App. Ezyserve does not warrant that this Website or the App; information, Content, materials, product or services included on or otherwise made available to you through its Website and App; the servers; or electronic communication sent from us are free of viruses or other harmful components.
  5. Ezyserve shall not be liable for any conduct or behaviour or actions of service providers. However, Ezyserve encourages you to notify us of any complaints that you may have against the service provider who has provided You with services on behalf of Ezyserve.
  6. You agree and acknowledge that the use of the Services offered by Ezyserve is at Your sole risk and that Ezyserve disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes are excluded to the fullest extent permitted by law.
  7. Ezyserve will not be liable for any damages of any kind arising from the use of the Service offered by the Company, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

2) Subject to applicable laws, in no event will ezyserve or its affiliates' aggregate liability arising from or related to the services exceed the payments actually received and retained by ezyserve from you for the paid services liability for any and all causes of action brought by you or your agents.

L) INDEMNITY           

The User unilaterally agree to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of our website or App or their breach of the terms. 

M) SERVICE RELATED, PAYMENT & REFUND

2) Any complaints in respect of the service should be raised within 24 hours from the service. In the event that any rework or refund is to be processed for the service it shall be initiated only within the warranty period for the respective service.

3) In the event that any rework is to be performed for any services that has already been rendered via a service provider Ezyserve should be contacted directly on info@ezyserve.in or +91-8544324429. Please do not call the Service Partner directly. In the event that any Customer directly contacts the service partner

  1. Ezyserve will not responsible for any actions or behavior of the Service partner, nor will it be responsible for any consequences thereof.
  2. The Customer shall have waived his / her / its right to any service warranty that may have been provided at the time of booking.

4) The rework of any rendered service would be done by either a Service Partner or a third party appointed by Ezyserve (at the discretion of Ezyserve).

5) Ezyserve would be liable only for the service rendered / appliance repaired / replaced. Further, Ezyserve would not be liable for any service / appliance which has been changed / altered post such rendering of service / repair, by you or any third party.

6) We do not undertake any repairs related to the printed circuit board (PCB) neither will we be able to provide any warranty for the same.

7) We do not undertake any repairs for appliances older that 5 years from the date of purchase neither will we be able to provide any warranty for the same.

8) Please report any payment or invoicing related issues within 48 (Forty Eight) hours of the job closure.

9) For issues within warranty period

10) The warranty terms (if any) are specifically mentioned on service pages of website and app and apply accordingly. The warranty if applicable on any service shall be applicable from the date of completion of the service, provided that the full amount for such service has been paid to Ezyserve.

11) In case you have any concerns with the work completed, Ezyserve may cause the service to be reworked free-of-cost, provided that such concern raised is bona fide and/or upon Ezyserve conducting an inspection, if necessary.

12) In case it is difficult to identify if the rework is related to the Ezyserve rendered service or not, we will send our technician to conduct an inspection, without any additional inspection charges and take a complete account of the situation. Post such inspection, if our technician is of the view that the rework is not related to the Ezyserve rendered service, no rework of the service will be rendered. You will further be liable to reimburse any and all charges of the technician for such inspection.

13) You acknowledge and agree that for categories, including, but not limited to, laundry, beauty, fitness, home cleaning, electrical fixing, plumbing, car repair/service, and painting, packers & movers, documentation services, a warranty and possibility of rework will not be applicable. Therefore, any issue reported with respect to the quality of service for these categories will be based on the outcome of inspection of the service provided.

14) Ezyserve reserve the right to increase or decrease service fee anytime without prior notice. User shall check present rate before booking service on website or app.

15) Compensation & Refund - 

  1. Compensation and Refund Processing any refund is at the complete discretion of Ezyserve. In all events, the maximum amount that Ezyserve will pay you as compensation or refund, shall be at the discretion of Housejoy, depending on the service availed by you, and shall not exceed the service amount paid by you for the respective service or Rs.10,000/- (Rupees Ten Thousand), whichever is lower. Under no circumstances will the maximum amount payable to you by Ezyserve exceed Rs.10,000/- (Rupees Ten Thousand).
  2. Ezyserve shall refund your payment if unable to fulfil booked service due to either service providers not attended or any any other reason of Ezyserve. However, service fee or advance booking amount is non refundable if the service is cancelled by Customer.
  3. Ezyserve shall not liable to refund any amount paid on our website or app whose purposes other than service booking in the functional serviceable area.
  4. Our Online payment partner is CCAvenue and we redirect your payment request from our portal to payment gateway for your safe payment. You shall not terminate or close window until your payment success message received.
  5. You Get payment confirmation via SMS/Email/whatsapp after success payment status received from our payment gateway CCavenue.

N) COOKIES

1) Cookies are small files that a site or its service provider transfers to your device’s hard drive through your web browser (if you permit it to) that enables the sites or service providers’ systems to recognise your browser and capture and remember certain information.

2) We use cookies to help us distinguish you from other users of the Platform, understand and save your preferences for future visits, keep track of advertisements and compile aggregate data about site traffic and site interaction so that we can offer you a seamless user experience. We may contact third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

2) Additionally, you may encounter cookies or other similar devices on certain pages of the Platform that are placed by third parties. We do not control the use of cookies by third parties. If you send us personal correspondence, such as emails, or if other users or third parties send us correspondence about your activities or postings on the Platform, we may collect such information within a file specific to you.

O) PRIVACY POLICY

1) By using the Platform, you consent to the collection, storage, usage, and disclosure of your personal data, as described in and collected by us in accordance with this Policy.

  a) Review and Updates: We regularly review and update our Privacy Policy, and we request you to regularly review this Policy. It is important that the personal data we hold about you is accurate and current. Please let us know if your personal data changes during your relationship with us.

 b) Third-Party Services: The Platform may include links to third-party websites, plug-ins, services, and applications (“Third-Party Services”). Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We neither control nor endorse these Third-Party Services and are not responsible for their privacy statements. When you leave the Platform or access third-party links through the Platform, we encourage you to read the privacy policy of such third-party service providers.

2) We collect different types of personal data about you at the time of your signup (registration) as user on our website or mobile and at the time of Booking service from your user’s account. We Also collect data through your reference. This includes, but is not limited to name, contact details, photo, address, IP address, bowser type, Internet service provider, device if, device type, etc. We also collect, use, and share aggregated data such as statistical or demographic data for any purpose. Aggregated data could be derived from your personal data but is not considered personal data under law as it does not directly or indirectly reveal your identity. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Policy.

3) Where we need to collect personal data by law, or under the terms of a contract (such as the Terms), and you fail to provide that data when requested, we may not be able to perform the contract (for example, to provide you with the Services). In this case, we may have to cancel or limit your access to the services.

4) Ezyserve use all personal data of users exclusively relating to Ezyserve service and do not sale/disclose to any third party except –

  1. to our Service Partner and Associates of our Service partner,
  2. to our payment gateway partner ( while making payment)
  3. to any alliance partner for providing various promotional and other benefits to our customers (users) from time to time basis their booking history with us.
  4. to the govt. agencies if demanded.

5) User have option to update his/her profile data  on our website or app with limitation.

P) DISCLAIMER

Except as required of Ezyserve under the consumer guarantees, the services are provided "as is" and “as available.” Ezyserve disclaims all representations and warranties, express, implied or statutory, not expressly set out in these terms, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, and makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of the services or any services requested through the use of the services, or that the services will be uninterrupted or error-free. Ezyserve does not guarantee the quality, suitability, safety or ability of third party providers. You agree that the entire risk arising out of your use of the services, and any service or good requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law, including the relevant consumer law legislation.

Q) MISCELLANEOUS

  1. These Terms of Use and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Ezyserve without restriction.
  2. These Terms of Use together with any other legal notices published by Ezyserve on its Platforms, shall constitute the entire agreement between you and Ezyserve concerning its Website and App and governs your use of our Website and App and Service, superseding any prior agreements between you and Ezyserve with respect to our Website and App and Service.
  3. The failure of Ezyserve to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Use remain in full force and effect
  4. These Terms of Use shall be governed by the laws of India, without respect to its conflict of laws principles. Any claim or dispute between you and Ezyserve that arises in whole or in part from our Website and App shall be decided exclusively by a court of competent jurisdiction located in Patna (Bihar), India.
